Please read these Terms of Service ("Terms") carefully before using the Malt Catering website and ordering platform (the "Service") operated by Malt Catering ("we", "us", or "our"), based in Thiruvananthapuram, Kerala, India.
By creating an account, placing an order, or otherwise accessing the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Eligibility
You must be at least 18 years of age and capable of entering into a legally binding contract under Indian law to use the Service. By using the Service you represent and warrant that you meet these requirements.
2. Account Registration
You may create an account using a valid phone number and password, or by signing in with a Google account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to provide accurate, current, and complete information during registration and to keep your delivery address and contact details up to date. We reserve the right to suspend or terminate accounts where we have reason to believe that information provided is false or misleading.
3. Ordering and Menu Availability
Our menu is published daily and is subject to change. Each meal slot (breakfast, lunch, dinner) has an individual booking cutoff time after which orders for that slot cannot be placed or modified. It is your responsibility to place orders before the applicable cutoff.
Placing an order constitutes an offer to purchase the selected meal slots. We reserve the right to decline or cancel any order at our discretion, including where a menu item is unavailable or where payment has not been received.
- Minimum order quantities and delivery fees, if any, are displayed at the time of checkout.
- Promotional codes are subject to their individual terms and may be withdrawn at any time.
- A confirmed order indicates that we have accepted your offer and committed to preparing and delivering the meal.
4. Pricing and Payment
All prices displayed are in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated. Delivery fees and GST, where applicable, are shown separately at checkout.
Payment is currently accepted via UPI, NEFT, RTGS, and cash. Payment details (transaction reference, mode, and date) must be communicated to us for manual confirmation. Your order will be marked as confirmed only after payment is verified by our staff.
Monthly billing customers agree to settle their invoice within the agreed billing cycle. Outstanding balances may result in suspension of the Service.
5. Cancellations and Refunds
You may cancel a confirmed order before the cancellation cutoff time applicable to that meal slot. Cancellations after the cutoff cannot be processed as food preparation will have begun.
Refunds for cancelled orders where payment has already been made will be credited to your Malt Catering account balance. Account balance can be applied to future orders. Cash refunds are not provided unless the cancellation is due to a failure on our part.
We reserve the right to cancel any order due to unforeseen circumstances (e.g., ingredient unavailability, staff shortage, or natural events). In such cases, a full credit will be applied to your account balance.
6. Delivery
Delivery is available within our defined service areas in and around Thiruvananthapuram, Kerala. Estimated delivery windows are indicative and not guaranteed. We are not liable for delays caused by traffic, weather, or other circumstances beyond our control.
It is your responsibility to ensure someone is available at the delivery address to receive the order. In the event of a failed delivery attempt due to your unavailability, the order may be forfeited without a refund for that delivery leg.
Delivery executives will contact you on the registered phone number if they are unable to locate the delivery address.
7. Food Safety and Allergens
Our meals are prepared in a kitchen that handles a variety of ingredients including dairy, eggs, gluten, nuts, and other common allergens. We cannot guarantee that any meal is free from allergen contamination.
If you have a food allergy or dietary restriction, you must notify us before placing an order. We will make reasonable efforts to accommodate your requirements but cannot accept liability for allergic reactions where full information was not provided in advance.
8. Tiffin Containers
Reusable tiffin containers (where applicable) remain the property of Malt Catering. You agree to keep them in reasonable condition and make them available for collection by our delivery executive at the time of the next delivery or upon request.
You are liable for the cost of replacing containers that are lost, damaged, or not returned within a reasonable period. We will notify you of any charges before applying them to your account.
9. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Interfere with or disrupt the integrity or performance of the Service
- Create multiple accounts for the purpose of misusing promotional codes or discounts
- Provide false delivery addresses or contact information
We reserve the right to suspend or permanently terminate accounts that violate these provisions, without notice or refund.
10. Limitation of Liability
To the maximum extent permitted by applicable Indian law, Malt Catering shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
Our total liability to you for any claim arising under these Terms shall not exceed the value of the order to which the claim relates.
11. Intellectual Property
All content on the Service, including text, graphics, logos, and software, is the property of Malt Catering or its licensors and is protected under applicable Indian intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Thiruvananthapuram, Kerala, India.
Before initiating legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at the details below. We will make reasonable efforts to resolve the matter within thirty (30) days.
13. Changes to These Terms
We may revise these Terms at any time. When changes are made, we will update the "Last updated" date at the top of this page. Continued use of the Service after the revised Terms are posted constitutes your acceptance of the changes.
For material changes, we will make reasonable efforts to notify you via your registered phone number or email address before the changes take effect.
